Professional liability is fairly straightforward on the surface. It offers protection to professionals (accountants, attorneys, architects, real estate brokers, consultants, funeral directors, etc..) against liability incurred as a result of errors and omissions in performing their professional services. This includes any actual or alleged breach of duty, neglect, error, misstatement, or omission. For example, a funeral director might accidentally cremate a body that was supposed to be buried. An accountant might inadvertently email confidential files to the wrong party. If you are in the business of serving others, chances are you have a professional liability exposure that exists. Some studies indicate that only 10-15% of small firms actually go forward with purchasing professional liability insurance which is rather alarming. Please remember, general liability offers coverage against claims from 3rd parties for bodily injury, property damage, or personal and advertising injury and specifically excludes professional liability.
